General Terms and Conditions of UmzugVergleichen.ch
1. Scope of Application
These General Terms and Conditions regulate the use of the UmzugVergleichen.ch platform for both private and commercial users (hereinafter referred to as users) and registered moving companies (hereinafter referred to as moving companies). By using the platform, both users and moving companies agree to these AGB.
2. Services of UmzugVergleichen.ch
For Users (Customers who plan a move):
- UmzugVergleichen.ch offers a free and non-binding comparison service for moving services.
- Users can submit a request for a move, which is forwarded to verified moving companies.
- Users receive up to 4 offers from moving companies to compare.
- It cannot be guaranteed that only 4 moving companies will contact the user, as we have no influence on what happens after a user purchases a request. If a moving company shares the request with third parties or otherwise uses it, this is outside our responsibility.
For Moving Companies (Partners who want to receive requests):
- UmzugVergleichen.ch provides moving companies with qualified requests from users.
- Moving companies can purchase requests and send offers to users.
- Purchased requests must only be used for the moving company's own use and may not be resold or shared with third parties.
- It is strictly prohibited to forward requests to other moving companies, partners, or intermediaries or to resell them. In case of violation, UmzugVergleichen.ch reserves the right to block the access of the relevant moving company without refund of already paid fees.
- UmzugVergleichen.ch guarantees no order placement by users and is not responsible for the final business relationship between moving companies and users.
3. Usage of the Platform
Obligations of Users:
- Users are obliged to make only truthful and complete statements about their moving needs.
- The use of the platform is free and non-binding.
- A contract relationship over a moving service comes exclusively between the user and the selected moving company.
Obligations of Moving Companies:
- Moving companies must only submit serious, market-compliant, and fair offers.
- It is prohibited to contact users in an inappropriate manner or to harass them.
- The transfer or resale of requests is expressly prohibited.
4. Liability
No liability for moving companies
- UmzugVergleichen.ch provides only a platform and is not a party to the contract between users and moving companies.
- UmzugVergleichen.ch does not assume responsibility for the actual move and the services provided by moving companies.
- All agreements regarding the scope, price, and quality of moving services are directly concluded between the user and the moving company.
No liability for damages or irregularities
- UmzugVergleichen.ch does not assume responsibility for damages to furniture or other items during the move.
- For stolen items or losses during the move, the moving company alone is responsible.
- UmzugVergleichen.ch is not liable for delays, punctuality, or non-fulfillment of agreements by the moving company.
- If a moving company increases the agreed price, is unreliable, or does not provide the services as promised, this is a matter between the user and the moving company.
No guarantee for a fixed number of offers
- UmzugVergleichen.ch strives to provide up to 4 moving companies for a request.
- However, it cannot be guaranteed that exactly 4 moving companies will contact the user.
- Once a moving company receives a request, UmzugVergleichen.ch has no influence on whether the moving company itself handles the request or forwards it to third parties.
5. Data Protection
- The processing of personal data is carried out in accordance with our privacy policy.
- User data is only forwarded to registered moving companies for the purpose of offering quotes.
- Moving companies agree to use the received customer data exclusively for the offer submission and not to forward it to third parties.
6. Costs & Payment Conditions for Moving Companies
- The use of the platform is free for users.
- Moving companies can purchase individual requests and send offers to users.
- The prices for the requests vary depending on the complexity of the request.
- The fee is payable regardless of whether the request ultimately leads to a move or not.
- The fee is payable when the request is purchased and is only refundable if the offer request is fraudulent.
- Once a moving company receives a request, UmzugVergleichen.ch has no influence on whether the moving company itself handles the request or forwards it to third parties.
7. Termination
- UmzugVergleichen.ch reserves the right to block moving companies in case of violations of these terms and conditions or other misconduct (e.g. false offers, spam, poor customer reviews) without refund of already paid fees.
- In case of a violation of the request forwarding prohibition or other misconduct (e.g. false offers, spam, poor customer reviews), UmzugVergleichen.ch reserves the right to block the relevant moving company without refund of already paid fees.
8. Changes to the terms and conditions
- UmzugVergleichen.ch reserves the right to adjust these terms and conditions at any time. The amended terms and conditions come into effect upon publication on the platform.
9. Final Provisions
- Swiss law applies.
- Jurisdiction is Zurich.
